John A. Mairs is a Member in the Firm's Tax Practice Group. His practice is focused in the area of state and local taxation and on the taxation of natural resource producers. Typically, he represents medium to large, national and international companies with business activities in West Virginia. He represents numerous West Virginia manufacturers, health care providers, coal companies, electric power producers and service businesses in evaluating tax compliance and minimization strategies for West Virginia corporate income and franchise taxes, sales and use taxes, severance taxes and gross receipt taxes on public utilities.
Mr. Mairs also regularly advises clients on local tax issues, such as ad valorem taxes on real and tangible personal property and municipal business and occupation taxes. A portion of his practice involves acting as a liaison between clients planning to locate new facilities or business operations in West Virginia and state and local economic development agencies to secure tax credits and incentives for business expansion within the state. He has an active tax dispute practice, representing clients contesting assessments of West Virginia taxes before the Office of Tax Appeals, West Virginia Circuit Courts and the West Virginia Supreme Court of Appeals, and contesting assessments of local business and occupation taxes and property taxes.
Mr. Mairs has been a frequent speaker on coal industry tax issues and sales and use tax issues. He has recently spoken on: "Federal and State Taxation of Export Coal" before the West Virginia Tax Institute and Energy & Mineral Law Foundation and on the issue of taxation of Internet businesses at a symposium sponsored by the West Virginia High Tech Consortium. Mr. Mairs is a member of the West Virginia and American Bar Associations and has been admitted to the West Virginia Bar and the United States District Court for the Southern District of West Virginia. Mr. Mairs received a Bachelor of Science in business administration from West Virginia University in 1978 and was licensed as a Certified Public Accountant in 1979. Mr. Mairs joined the Firm upon receiving his Juris Doctor from West Virginia University College of Law in 1983.
