Update: Prison for Two and Probation for Two in Navy Kickback Scheme
February 3, 2014
As an update to the article posted here about former Navy Engineer Ralph Mariano, four additional defendants were sentenced for their roles in the scheme. Anjan Dutta-Gupta, founder of the technology company Advanced Services for Tomorrow (ASFT), was sentenced to three years in prison and ordered to pay $17.9 million in restitution. During the sentencing proceeding, attorneys for Dutta-Gupta and attorneys for the government requested that Dutta-Guptas sentence be reduced based on his significant cooperation with the government in the case. Another former AFST executive, Patrick Nagle, received three years of probation, and a subcontractor, Russell Spencer also received a three year sentence. Nagle and Spencer were given credit for cooperating with the government.
Finally, Mary ORourke, Marianos former girlfriend who also worked at AFST, was sentenced to five years of probation, nine months of home confinement, restitution of $478,000, 1,000 hours of community service, and a $4,000 fine. Ms. ORourke was an attorney who is now disbarred. According to news reports, United States District Judge Mary M. Lisi stated that although the case cries out for a jail sentence, the Judge gave the sentence the government recommended in its plea agreement.
It appears that all of the major participants in the case have now been sentenced.
