Lawyers in Jackson Kelly’s Class Action and Complex Litigation practice group have considerable experience in the handling and management of mass litigation. Our attorneys represent pharmaceutical and device manufacturers, chemical and manufacturing companies, coal companies, and other entities in class action, mass tort and complex business litigation, including lender liability, breach of contract, intellectual property, and other statutory and common law claims.
Our class action and complex litigation experience extends to a wide range of toxic tort cases arising out of accidents, chemical releases, fires, and explosions; alleged chronic exposures by workers or members of the community; and other injuries alleged by consumers. The substances and products that served as the basis for these suits include: chemicals and substances such as PCBs, asbestos, silica, pesticides, herbicides, pulp mill products, acrylates, acrylamide, lead, toluene, benzene, methyl isocyanate; medical devices such as breast implants and contraceptives; and pharmaceuticals such as diet drugs and other over-the-counter and prescription medications.
Our attorneys in the Class Action and Complex Litigation practice group are nationally recognized. Several are Fellows of the American College of Trial Lawyers and members of the American Board of Trial Advocates. Our lawyers serve as national coordinating counsel for several asbestos and silica defendants and as defense liaison counsel in a national pharmaceutical litigation that was consolidated by the Multi-District Litigation Panel in the United States District Court for the Southern District of West Virginia.Through these roles, attorneys work closely with in-house counsel and local counsel in various jurisdictions to coordinate and manage their litigation in a predictable and cost-effective manner.
As coordinating counsel, the Firm identifies and presents company employees to testify, locates and recommends expert witnesses, and coordinates discovery and litigation for cases across various jurisdictions. We assist our clients in controlling litigation and associated expenses, including cost and settlement analysis, auditing current litigation services, and reviewing and reporting on the status of pending and threatened litigation. By working closely with local counsel handling matters and reviewing file documents, court records, and other materials, the Firm provides its clients with analyses of issues relating to individual cases, trends and problem issues, and with general risk assessments for the litigation. Our attorneys also serve as regional, state, and local counsel for clients in numerous other national litigation matters and frequently act as liaison counsel for various defense groups.
