MSHA PROPOSES DELAYING EFFECTIVE DATE OF WORKPLACE EXAMINATION RULE

Today the Mine Safety and Health Administration (“MSHA”) proposed delaying the effective date of its rule for workplace examinations in metal and nonmetal mines until July 24, 2017. MSHA published this update as a proposed rule in the Federal Register. Until MSHA publishes this extension as a final rule, the effective date remains May 23, 2017.

This March 27, 2017, proposal would change only the effective date of the rule. It makes no substantive changes. The proposed change provides that the delay would allow time for MSHA to provide training and compliance assistance to operators and miners.

MSHA solicits comments on the limited issue of whether to extend the effective date to July 24, 2017, and whether this extension offers an appropriate length of time for training and compliance assistance. The deadline to submit comments is April 26, 2017.
