MSHA SCHEDULES ADDITIONAL COMPLIANCE ASSISTANCE MEETINGS FOR M/NM WORKPLACE EXAM FINAL RULE

As most metal/nonmetal mine operators know by now, the Mine Safety and Health Administration (“MSHA”) published the Final Rule amending requirements for workplace examinations on April 9, 2018. The substance of the Final Rule is discussed in a previous Jackson Kelly news alert, which is available here.
On Wednesday, April 19, 2018, MSHA published information regarding one additional stakeholder meeting to be held for compliance assistance along with notice of two video teleconferences. The additional stakeholder meeting is scheduled on May 3, 2018, in Seattle, Washington.
The video teleconferences are scheduled for May 10 and June 6, starting at 11:00 a.m. Eastern time. People interested in the video conferences may either attend in-person at MSHA’s Headquarters in Arlington, Virginia or attend at one of the seven local MSHA offices around the country: Beckley, WV; Birmingham, AL; Denver, CO; Mesa, AZ; Duluth, MN; Warrendale, PA; and Vacaville, CA. In order to participate in any of the video teleconferences, you must send an e-mail to MSHA at zzMSHAcomments@dol.gov. Given the effective date of June 2, 2018, mine operators have a very limited amount of time to review their current workplace examination process and method of recording the examination to determine whether changes need to be made in order to comply with the Final Rule.
