WORKPLACE EXAMINATION RULE UPDATE

The Mine Safety and Health Administration (“MSHA”) has indicated it is finalizing an extension on the workplace examination final rule to be published in the Federal Register prior to the current effective date of May 23, 2017. It remains unclear how long the extension will be; however, MSHA has indicated it will provide enough time for stakeholder meetings and industry outreach.
The workplace examinations rule remains under challenge in the 11th Circuit Court of Appeals. On April 24, 2017, the Petitioners filed a motion for judicial stay to delay the effective date of the final rule while the case is pending. The Court has yet to rule on the request for stay. We will provide updates as they become available.
